1. Data Collection Purpose
ZenovaraSolutions collects personal data exclusively for the purpose of executing requested web engineering services, maintaining communication regarding project status, and fulfilling legal obligations under the General Data Protection Regulation (EU) 2016/679.
2. Types of Data Processed
We process identification data (name, email address), communication data (inquiry content), and technical data (IP address, browser type) necessary for service delivery and security protocols.
3. Legal Basis for Processing
Data processing is conducted under Article 6(1)(b) GDPR — necessity for contract performance, and Article 6(1)(f) — legitimate interest in service optimization and security.
4. Data Retention
Personal data is retained for the duration necessary to fulfill the contracted services and for a maximum period of 5 years post-completion, in compliance with Spanish commercial record-keeping requirements.
5. Data Subject Rights
Under Articles 15-22 GDPR, you have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. Requests should be directed to [email protected].
6. International Transfers
ZenovaraSolutions does not transfer personal data outside the European Economic Area without appropriate safeguards including Standard Contractual Clauses approved by the European Commission.
7. Security Measures
We implement technical and organizational measures including encryption, access controls, and regular security assessments to protect personal data against unauthorized access, alteration, or destruction.
8. Supervisory Authority
You have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) at www.aepd.es if you believe your data protection rights have been infringed.
REFUND_VECTOR

1. Refund Eligibility
Refund requests are evaluated on a case-by-case basis in accordance with European Consumer Rights Directive 2011/83/EU. Services that have been substantially performed or delivered are non-refundable.
2. Pre-Service Cancellation
Cancellations made within 14 calendar days of contract initiation, before substantial work has commenced, are eligible for full refund minus administrative processing fees of 5%.
3. Milestone-Based Refunds
For projects structured around milestones, refunds may be issued for undelivered milestones only. Completed milestones are non-refundable. Assessment is based on documented project progress records.
4. Defective Service
If delivered services fail to meet the specifications outlined in the service agreement, ZenovaraSolutions will either rectify the deficiencies within a reasonable timeframe or issue a proportional refund.
5. Refund Processing
Approved refunds are processed within 14 business days to the original payment method. Processing times may vary depending on the payment provider.
6. Dispute Resolution
Refund disputes may be escalated to [email protected]. Unresolved disputes may be submitted to the European Online Dispute Resolution platform at ec.europa.eu/odr.
SERVICE_MATRIX

1. Service Scope
ZenovaraSolutions provides web engineering, custom framework configuration, responsive layout development, and related digital services. Service specifications are defined in individual project agreements.
2. Contract Formation
Service agreements are formed upon written confirmation of project scope and receipt of initial payment. Quotations remain valid for 30 calendar days from issuance.
3. Payment Terms
Invoices are payable within 14 calendar days of issuance. Late payments incur a statutory interest rate of 8% per annum plus applicable recovery costs per EU Directive 2011/7/EU.
4. Intellectual Property
Upon full payment, all intellectual property rights for custom-developed deliverables transfer to the client. Pre-existing frameworks, libraries, and tools remain property of their respective owners.
5. Confidentiality
Both parties agree to maintain strict confidentiality regarding project specifications, business information, and technical implementations for a period of 3 years post-completion.
6. Liability Limitation
ZenovaraSolutions liability is limited to the total value of the service agreement. We shall not be liable for indirect damages, data loss, or business interruption beyond the contract value.
7. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond reasonable control, including natural disasters, cyberattacks, or governmental actions.
8. Governing Law
These terms are governed by Spanish law. Disputes shall be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain.
9. Amendments
ZenovaraSolutions reserves the right to amend these terms with 30 days written notice. Continued use of services constitutes acceptance of amended terms.
